API License Agreement

This API License Agreement ("Agreement") governs your access to and use of the INCI API service provided by Andrii Sukhanov, operating as INCI API ("we," "us," or "our"), autónomo registered in Spain (NIE: Z2338955K). By accessing or using the INCI API, you agree to be bound by this Agreement. This Agreement supplements our Terms of Service.

1. Grant of License

Subject to your compliance with this Agreement and the Terms of Service, INCI API grants you a non-exclusive, non-transferable, revocable, limited license to access and use the INCI API in accordance with the documentation and your subscription tier.

This license is personal to you and may not be sublicensed, assigned, or transferred to any third party without our prior written consent.

2. Permitted Uses

Under this license, you may:

  • Integrate INCI API data into your applications, websites, or services
  • Display ingredient safety information, allergen reports, skin compatibility data, and pregnancy safety information to your end users
  • Cache API responses locally for up to 24 hours to reduce redundant requests
  • Use the data for internal analytics, reporting, and business intelligence
  • Create derivative works (e.g., visualizations, summaries) based on INCI API data, provided attribution requirements are met

3. Prohibited Uses

Under this license, you may not:

  • Resell, redistribute, or sublicense raw API data as a competing ingredient analysis or barcode lookup service
  • Systematically scrape, bulk-download, or attempt to replicate the entire INCI API database
  • Remove, alter, or obscure INCI API attribution in any display of the data
  • Use the data to provide medical advice, clinical diagnoses, or therapeutic recommendations. INCI API provides informational data only
  • Exceed your subscription tier's rate limits or usage quotas, or circumvent rate limiting mechanisms
  • Share, publish, or expose your API keys to third parties or in client-side code
  • Use the API in a manner that violates any applicable law, regulation, or third-party rights
  • Reverse engineer, decompile, or attempt to extract the source code or algorithms underlying the INCI API
  • Use automated tools to overwhelm, stress-test, or disrupt the INCI API infrastructure

4. Data Attribution

When displaying INCI API data to end users in your application, website, or service, you must include the following attribution in a reasonably visible location:

Attribution may be placed in a footer, about page, credits section, or similar location where it is accessible to end users. Attribution is not required for internal-only use or analytics dashboards not visible to end users.

5. Data Accuracy Disclaimer

Ingredient safety data, allergen information, skin compatibility analysis, pregnancy safety reports, and clean beauty scores provided by INCI API are for informational purposes only.

INCI API does not provide medical advice, clinical diagnoses, or therapeutic recommendations. Users should consult qualified healthcare professionals, dermatologists, or allergists for medical decisions related to cosmetics and personal care products.

Our data is sourced from publicly available databases and scientific literature, including:

  • EU CosIng (European Commission Cosmetic Ingredient Database) — CC BY 4.0
  • EU Regulation 1223/2009 and amendment 2023/1545 — allergen list and cosmetics safety regulations
  • Open Beauty Facts — crowdsourced product database (ODbL)
  • Fulton 1989 comedogenicity scale — peer-reviewed comedogenicity ratings
  • Cosmetic Ingredient Review (CIR) — industry safety assessments

While we strive for accuracy and regularly update our database, we do not guarantee the completeness, timeliness, or error-free nature of the data. Product formulations may change without notice from manufacturers.

6. Intellectual Property

6.1 INCI API Proprietary Rights

The INCI API service, including its design, documentation, scoring algorithms, safety analysis methods, and proprietary database enhancements, is owned by INCI API. This Agreement does not transfer any ownership rights to you.

6.2 Third-Party Data Licenses

Underlying ingredient data sourced from public databases retains its original license. When using INCI API data, you must also comply with the following third-party data licenses:

  • EU CosIng data: Creative Commons Attribution 4.0 International (CC BY 4.0)
  • Open Beauty Facts data: Open Database License (ODbL 1.0)
  • PubMed abstracts: Subject to NLM terms of use

6.3 Your Content

You retain ownership of any content, data, or applications you create using the INCI API. By submitting product data through our crowdsourcing endpoint, you grant us a non-exclusive, royalty-free license to use, store, and distribute that data as part of the INCI API service.

7. Rate Limits and Fair Use

API access is subject to the rate limits and usage quotas defined by your subscription tier:

Automated systems must respect rate limit response headers:

  • X-RateLimit-Limit — Maximum requests allowed in the current window
  • X-RateLimit-Remaining — Remaining requests in the current window
  • X-RateLimit-Reset — Timestamp when the rate limit resets
  • Retry-After — Seconds to wait before retrying (sent with 429 responses)

Exceeding rate limits will result in HTTP 429 (Too Many Requests) responses. Persistent or intentional abuse may result in temporary or permanent suspension of API access.

8. Termination

We may suspend or terminate your API access immediately if you violate this Agreement, including but not limited to:

  • Exceeding rate limits after repeated warnings
  • Engaging in prohibited uses as described in Section 3
  • Failure to maintain required attribution
  • Non-payment of subscription fees
  • Any activity that threatens the security or integrity of the service

You may terminate this Agreement at any time by canceling your subscription and ceasing to use the API. Upon termination, you must destroy all cached API data within 30 days and remove INCI API integrations from your applications.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, INCI API'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO INCI API IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

IN NO EVENT SHALL INCI API BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT, REGARDLESS OF THE THEORY OF LIABILITY.

Nothing in this Agreement excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.

10. Changes to This Agreement

We may update this Agreement from time to time. We will provide at least 30 days' prior notice of material changes via email to the address associated with your account. Your continued use of the INCI API after the effective date of changes constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the API and cancel your subscription before the changes take effect.

Governing Law

This Agreement is governed by the laws of Spain. Any dispute arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts located in the Canary Islands, Spain. INCI API is operated by an autónomo (sole proprietor) registered in Spain under the Canary Islands Special Economic Zone (ZEC), subject to the IGIC tax regime (Impuesto General Indirecto Canario), which replaces standard EU VAT for services rendered from the Canary Islands.
