Terms of Service

These Terms of Service ("Terms") govern your access to and use of the INCI API service, website, and related products (collectively, the "Service") provided by INCI API ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Acceptance of Terms

By creating an account, accessing our API, or using our website, you confirm that you are at least 18 years old (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

INCI API provides a RESTful application programming interface (API) for cosmetic product ingredient analysis. The Service includes:

  • Barcode lookup for cosmetic products (UPC/EAN)
  • INCI (International Nomenclature of Cosmetic Ingredients) list parsing and analysis
  • Ingredient safety scoring based on published research and regulatory data
  • Allergen detection aligned with EU Regulation 1223/2009
  • Skin compatibility analysis by skin type
  • Pregnancy safety assessment
  • Clean beauty scoring
  • Ingredient database search and lookup
  • A web dashboard for managing your account, API keys, and usage

3. Account Registration and Security

To access the API, you must create an account. You agree to:

  • Provide accurate and complete registration information
  • Keep your login credentials and API keys confidential
  • Notify us immediately of any unauthorized use of your account
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are compromised.

4. API Usage Rules

When using the API, you agree to:

  • Comply with the rate limits and usage quotas associated with your subscription tier
  • Include valid authentication (API key) with each request
  • Not share, publish, or expose your API keys publicly
  • Not attempt to circumvent rate limits, authentication, or access controls
  • Not use automated tools to scrape or bulk-download our entire database
  • Not reverse-engineer, decompile, or attempt to extract source code from the API
  • Cache API responses responsibly and in accordance with returned cache headers

We may throttle, suspend, or terminate API access for accounts that violate these rules or generate excessive load that degrades the Service for other users.

5. Subscription and Billing

5.1 Plans

We offer multiple subscription tiers, including a free tier. Current plans and pricing are displayed on our Pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

5.2 Billing Cycle

Paid subscriptions are billed monthly in advance. Your subscription automatically renews at the end of each billing period unless you cancel before the renewal date.

5.3 Cancellation and Refunds

You may cancel your subscription at any time through the dashboard. Upon cancellation, you retain access to paid features until the end of your current billing period. We do not provide prorated refunds for partial billing periods, except as required by applicable law.

5.4 Payment Processing

All payments are processed securely by Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. You are responsible for maintaining valid payment information.

6. Data Accuracy Disclaimer

IMPORTANT: Please read this section carefully. This section defines the limitations of the data provided by INCI API.

The ingredient data, safety scores, allergen information, skin compatibility assessments, pregnancy safety flags, clean beauty scores, comedogenicity ratings, and all other analysis provided through the Service are for informational and educational purposes only. They are:

  • Not medical advice. The Service does not provide medical diagnoses, treatment recommendations, or clinical guidance. INCI API is not a healthcare provider and does not practice medicine or dermatology.
  • Not a substitute for professional consultation. Users with specific health concerns, allergies, skin conditions, or who are pregnant or breastfeeding should consult a qualified healthcare professional or dermatologist before making decisions about cosmetic products.
  • Algorithmic estimates, not clinical assessments. Safety scores and ratings are generated through algorithmic analysis of available data. They are not verified by clinical trials, peer review, or individual patient evaluation.
  • Based on published research and regulatory data. Our data is compiled from sources such as the EU CosIng database, EU Regulation 1223/2009, CIR reports, PubMed publications, and other publicly available scientific literature. We strive for accuracy but cannot guarantee completeness or timeliness.
  • Subject to change and potential error. Ingredient safety assessments may change as new research is published or regulations are updated. Data may contain errors, omissions, or outdated information.
  • Not guaranteed. We do not warrant the accuracy, completeness, timeliness, or reliability of any data provided through the Service.

By using the Service, you acknowledge and agree that:

  • You must independently verify all ingredient information before making decisions that may affect your health, safety, or well-being.
  • INCI API is not liable for any adverse effects, allergic reactions, skin irritation, or other harm resulting from reliance on the data provided through the Service.
  • Individual responses to cosmetic ingredients vary significantly. A safety score does not predict how any specific individual will react to a product or ingredient.
  • You will not use INCI API data to make medical claims, provide clinical advice to end users, or represent the data as medically validated without appropriate independent verification and disclaimers.

You use the data entirely at your own risk. INCI API expressly disclaims all liability for any decisions made based on the information provided.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, features, code, documentation, logos, and trademarks, is owned by INCI API and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without prior written consent.

7.2 API Output

You may use data retrieved through the API in your applications, products, and services, subject to these Terms. You may not resell raw API data as a standalone dataset or competing service.

7.3 Open Data Attribution

Portions of our ingredient data are derived from open data sources, including EU CosIng (CC BY 4.0) and Open Beauty Facts (ODbL). Where required by the source license, appropriate attribution is provided. Your use of such data through our API must comply with the applicable open data licenses.

8. User-Submitted Content

If you submit product information, corrections, or other content through our crowdsourcing features, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content as part of the Service. You represent that you have the right to submit such content and that it does not infringe any third-party rights.

9. Prohibited Uses

You agree not to use the Service to:

  • Violate any applicable law or regulation
  • Infringe on intellectual property rights of others
  • Transmit malicious code, viruses, or harmful data
  • Attempt to gain unauthorized access to the Service or its infrastructure
  • Engage in denial-of-service attacks or other disruptive activities
  • Misrepresent your identity or affiliation
  • Use the data to make medical claims or provide clinical advice to end users without appropriate disclaimers
  • Systematically download or scrape the entire ingredient database

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL INCI API BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

11. Indemnification

You agree to indemnify, defend, and hold harmless INCI API and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination include but are not limited to:

  • Violation of these Terms
  • Non-payment of subscription fees
  • Abusive or fraudulent activity
  • Extended inactivity (accounts inactive for more than 12 months)

Upon termination, your right to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will remain in effect.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page with a revised effective date. For significant changes, we may also notify you via email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your subscription.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Spain. Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Canary Islands, Spain. INCI API is operated by an autónomo (sole proprietor) registered in Spain under the Canary Islands Special Economic Zone (ZEC), subject to the IGIC tax regime (Impuesto General Indirecto Canario), which replaces standard EU VAT for services rendered from the Canary Islands.

15. Disputes and Conflict of Laws

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, either party may pursue resolution through binding arbitration or the courts of competent jurisdiction, as permitted by applicable law.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
